New rules for foreigners awaiting deportation at Polish airports

Starting from April 7, 2023, new rules regarding foreigners awaiting deportation will be in effect at 17 Polish airports. The changes have been introduced based on recommendations from the Council of Europe, aimed at eliminating shortcomings identified during inspections at Warsaw Airport in 2019.

The new regulations concern approximately one thousand foreigners who have been denied entry to Poland, including those staying illegally in the country or crossing the border unlawfully. Under the new rules, foreigners must be promptly informed of their rights and obligations. Their detention at the airport may last a maximum of seven days, and families must be ensured privacy.

Poland does not intend to create special facilities for foreigners at rail, road, and maritime border crossings – the changes only concern airports. Costs related to the stay, utilities, and meals of a foreigner denied entry are to be covered by the carrier.

Rooms for foreigners must meet specific requirements, such as burglar-proof windows, proper ventilation and temperature, and adequate lighting for reading and writing. Additionally, these rooms will be equipped with buttons for calling Border Guard officers. Furniture such as beds, cabinets, and tables must have no sharp edges. Airports must also guarantee access to lit and heated sanitary facilities.

A foreigner awaiting deportation must receive written information about their rights and obligations in a language they understand. They must also be informed that their room is monitored, and they must familiarize themselves with the rules for staying in the facilities and sign the appropriate document. This person is obliged to follow the orders of Border Guard officers, social coexistence rules, and maintain personal hygiene and room cleanliness.

The introduced changes aim to improve the living conditions of foreigners awaiting deportation and increase the observance of their rights. The new rules will apply to 17 Polish airports, and their introduction is a result of implementing the Council of Europe’s recommendations.
